These terms govern your use of callforge.us and the AI phone answering services provided by Call Forge LLC. By using our website or services, you agree to these terms. If you do not agree, do not use the services. Contact: [email protected] or (360) 930-2308.
CallForge provides AI-powered voice agents that answer inbound telephone calls on behalf of business customers, qualify callers, capture job details, and book appointments onto the customer calendar. Specific features, call volumes, and pricing are set out in your order form or written agreement with us. We may modify, improve, or discontinue features over time and will give reasonable notice of material changes that reduce core functionality.
You must be at least 18 and able to enter a binding contract. If you use the services on behalf of a business, you represent that you are authorized to bind that business. You are responsible for the accuracy of information you give us, for the security of your account credentials, and for all activity under your account.
Call recording disclosure: CallForge records and transcribes calls. You must ensure callers are properly notified and that recording complies with the laws of every jurisdiction you receive calls from. Washington and several other states require all-party consent. This obligation is yours, not ours. Consent for messaging: if we send texts to your customers on your behalf, you must have obtained valid consent, and your use must comply with the TCPA and applicable carrier rules. Lawful use: you will not use the services for unlawful, fraudulent, harassing, or deceptive purposes. Accuracy: you are responsible for the accuracy of the business information the AI agent communicates to callers, including services offered, service area, hours, and pricing.
You may not reverse engineer, decompile, or attempt to extract the underlying models or source code; resell, sublicense, or white-label the services without our written agreement; use the services to make or facilitate unsolicited automated calls or messages; interfere with, overload, or attempt to gain unauthorized access to our systems; or use the services to collect sensitive categories of information, including health, financial account, or government identification numbers. We may suspend or terminate access for violations.
Our voice agents are automated systems. They are not human and they are not perfect. The AI may misunderstand a caller, capture a detail incorrectly, or fail to handle an unusual request. The AI does not provide professional, legal, medical, or emergency advice. The services are not suitable for emergency calls; you must not represent CallForge as an emergency line and should direct callers with emergencies to appropriate emergency services. You are responsible for reviewing bookings and captured information before acting on them, and you accept the risk that automated systems produce errors.
Fees, billing frequency, and included call volumes are set out in your order form. Unless stated otherwise, fees are billed in advance and are non-refundable except as required by law; overage charges apply to usage beyond your plan volume; we may change pricing with at least 30 days' written notice effective at your next renewal; and late payments may result in suspension of service.
Unless your order form says otherwise, subscriptions renew automatically for successive terms. You may cancel effective at the end of your current term by contacting [email protected]. We may suspend or terminate immediately if you breach these Terms, fail to pay, or use the services in a way that creates legal risk or harms our systems or other customers. On termination your right to use the services ends; you may request an export of your call records within 30 days, after which we may delete them.
You retain ownership of your business information and of the call recordings, transcripts, and caller details generated on your behalf and grant us a limited license to process that data to provide the services. We may use aggregated and de-identified data, which cannot reasonably be used to identify you, your business, or any caller, to improve and train our systems. We own the CallForge platform, software, models, and branding; nothing in these terms transfers our intellectual property to you.
The services rely on third-party providers, including telephony carriers, HighLevel, and Google. Outages, changes, or failures of those providers may affect the services. We are not liable for third-party failures outside our reasonable control.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT EVERY CALL WILL BE ANSWERED, OR THAT THE AI WILL CAPTURE INFORMATION ACCURATELY IN EVERY CASE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, or data, even if advised of the possibility. Our total aggregate liability arising out of or relating to the services will not exceed the amount you paid us in the three (3) months immediately preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
You agree to indemnify and hold harmless Call Forge LLC and its officers, employees, and agents from any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the services, your breach of these Terms, your failure to obtain required call recording or messaging consents, or your violation of any law or third-party right.
These terms are governed by the laws of the State of Washington without regard to conflict of law principles. Any dispute will be brought exclusively in the state or federal courts located in Kitsap County, Washington, and both parties consent to that jurisdiction.
We may update these terms. Material changes take effect 30 days after we post them or notify you. Continued use after that date means you accept the updated terms.
These terms together with your order form are the entire agreement between us. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent.
